Terms and Conditions for tour participation with
Hebridean Services Limited t/a the Night Sky Wonderer
- Introduction
1.1
These Terms and Conditions (“Terms”) govern the use of services provided by Hebridean Services Limited t/a the DayLight Wanderer (“Company/we”). By booking a tour, which is defined as making a deposit or full payment for any tour through https://daylightwanderer.com (“the website”) or via telephone call or writing, prior to tour booking confirmation, with the Company, the lead booker and/or payment maker (“you”) agree to these Terms and you assure that you’re party, anyone else you are making a booking for, have read and agree with these Terms.
1.2
By booking with Hebridean Services Limited t/a the DayLight Wanderer, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
2. Booking and Payment
2.1
Availability and booking enquiries can only be made at the website. Bookings are final once we receive notification of your payment. Bookings must be made at least 24 hours prior to any tour start date and time. Our tours do not carry cash.
2.2
Children between the ages of 3 and 16 years are carried on our tour and up to two children must be accompanied by a responsible adult who is 18+ years of age or older. One adult may take a maximum of 2 children on any booking.
2.3
The lead booker must be at least 18 years of age.
2.4
We do not carry animals. Guide dogs are carried and should be booked separately on the booking form at the website to ensure they have sufficient space. You must ensure the dog is comfortable, safe and secured in travel via use of an approved pet seatbelt which you must supply.
2.5
All bookings are subject to availability and confirmation by the Company.
2.6
Full payment is required at the time of booking unless otherwise stated.
2.7
Prices are subject to change without notice; however, confirmed bookings will not be affected.
2.8
Discounts and promotional offers cannot be combined unless explicitly stated otherwise and are single use only unless explicitly stated otherwise.
2.9
Your payment only covers the cost of participating in our tour. It does not cover travel costs to our departure point or from our arrival point at the end. It does not cover the cost of entry to any attractions. It covers no food or drink costs.
3. Cancellations & Refunds
3.1
Cancellations made by you must be made in writing. The entire booking is refundable up to 24 hours prior to departure less any transaction fees from any party whether on your part our ours.
Within 24 hours of of the tour no refunds shall be provided. This also applies to cruise ship guests who’s ship fails to dock leading to the failure to show for our tours. We recommend travel insurance to cover this eventuality.
3.2
If you are not in attendance, or any member of your booked party are not in attendance, at the tour pick-up point 15 minutes prior to the tour start time this will be treated as a ‘cancellation within 24 hours’ and may result in you being unable to take the tour and unable to receive a refund.
You are responsible for ensuring you are at the correct tour pick-up point, following our clearly communicated directions in your booking documentation, including text, map links and photographs. You should call us on the contact number if you are unable to determine the pick-up point. We do not pick-up, or drop-off, at any other location.
3.3
If you leave the tour, or any member of your booked party leave the tour, prior to the start or whilst it is running, or if you, or any member of your group, fail to return to the vehicle in time for a departure during the tour, you do so at your own risk, and this will be considered a ‘cancellation within 24 hours’, and no refund will be applied. Further you will also be required to make your own way back to the departure point for the tour.
3.4
We rarely cancel tours. The Company reserves the right to cancel or modify a tour due to unforeseen circumstances, including, but not limited to, road closures, road traffic accidents whilst on the tour, extreme weather conditions, mechanical issues, insufficient staffing to operate safely or insufficient bookings. In such cases, customers will receive a full refund or an option to reschedule.
3.5
If we cancel a tour, 100% refunds, less any transaction fees from any party whether on your part our ours, will be processed within 14 business days of cancellation.
4. Tour Itinerary and Changes
4.1
The Company reserves the right to modify the tour itinerary, schedule, or stops for operational or safety reasons including such things as, but not limited to, time of the year adaptations, weather, road closures, site closures etc. This includes on-the-day amendments.
4.2
All efforts will be made to inform customers of significant changes in advance.
4.3
If you wish to make changes you must contact us in writing to do so. We will endeavour to meet your request but partial or full cancellations, including reductions in attendees, remain non-refundable for any reason except if cancelled by us.
5. Customer Responsibilities
5.1
All customers, including the lead booker and all members of their booked party, must:
- note that making a payment to us indicates your acceptance, and the acceptance of all of your booked party individually, of these Terms and Conditions and that you have read and can adhere to the questions and answers listed in the FAQ section, available here.
- arrive at the designated pickup point at least 15 minutes before the scheduled departure time. Late arrivals may result in forfeiture of the booking without a refund. If you are having difficulty finding our departure point you must call us. We do not collect from, or check, any other departure points you may be at, including the Deep Water Port.
- ensure you meet the physical and medical requirements for the tour as noted in the FAQ section (available here). If you do not, as assessed by the tour operator on arrival at the tour start time, you may be refused boarding and will not receive any refund, although you may be permitted to rebook.
- adhere to safety guidelines and instructions provided by the tour guide or driver.
- be responsible for their personal belongings which must be limited to small personal items/bags only.
- not take large luggage items, strollers, push-chairs, large medical equipment or large walking aids which are not conveyed and will not be permitted on the bus. We will not allow any extra time before a tour begins for you, or any member of your booked party, to make arrangements for luggage, animals, un-booked tour members, or any other reason.
5.2
The Company is not liable for lost, stolen, or damaged items belonging to any booked member of our tours.
5.3
Any damages caused to the bus or equipment by you, or anyone in your booked party, or guide dogs, may result in additional charges which will be charged to the card used at the time of booking.
5.4
We strongly advise that you buy travel insurance policies that provide cover for, but not limited to:
- cancelled tours
- tours you were unable to attend due to weather, failed transport providers and/or other foreseeable and unforeseeable events
- failure of your vessel (aircraft, cruise ship, service ferry etc.) to land or dock in time to take the tour
- medical cover
- financial loss
- over-night accommodation and
- food provision for you and your entire booked party
6. Health and Safety and Compliance with Scots Law
6.1
Customers must inform the Company of any medical conditions, disabilities, or special requirements prior to booking i.e. prior to making any payment for our tours. For purely safety reasons, and to comply with insurance requirements, some conditions may result in a refusal to book.
6.2
Seatbelts must be worn on our tours and is a legal requirement in the UK. Failure to use a seatbelt will result in you being off-loaded. If you have a medical exemption from wearing a seatbelt you must carry the original, or a copy, of the authorisation so that, in the event of being stopped by the police, DVSA or Traffic Commissioner you are not endangering the Company or driver.
6.3
Our tours involve the use of a vehicle, the supply of hot and cold liquids, the supply of biscuits and chocolate products, some of which may contain nuts or other allergens. A safety briefing will be supplied on these at the outset, which was also detailed prior to booking, and you must confirm, after this briefing, that you are willing to participate. If not, this will be deemed a cancellation within 24 hours, and you must off-load from the tour.
6.4
The Company reserves the right to refuse service to customers deemed unfit for the tour for safety reasons including physical disposition, the carrying of prohibited items or any other reason identified by the tour guide which breaches our Terms and Conditions and/or Our Charter. Refunds will not be provided for these customers.
6.5
The consumption of alcohol, illegal substances, or smoking is strictly prohibited on the vehicle and throughout the tour.
6.6
If you, or a member of your group, arrive intoxicated, or unable to control your own actions, or you are belligerent, you will be refused boarding, or the tour will be cancelled and all guests will be returned to the start location. Refunds cannot be provided for tour members who violate this condition.
7. Liability
7.1
The Company is not liable for any injuries, illnesses, damages, or losses incurred during the tour, including by other tour participants, except where caused by the Company’s negligence.
7.2
The Company’s liability for any claim is limited to the amount paid for the tour.
8. Force Majeure
8.1
The Company is not responsible for delays, cancellations, or disruptions caused by events beyond its control, including, but not limited to, natural disasters, strikes, government restrictions, or pandemics.
9. Privacy Policy
9.1
The Company respects your privacy and handles personal information in accordance with applicable data protection laws. Personal details provided during booking will only be used for tour operations and communication purposes. More information can be found on the hebrideanservices.com website.
10. Governing Law
10.1
These Terms are governed by the laws of Scotland. Any disputes arising from these Terms shall be resolved in the courts of Scotland.
10.2
If any of these Terms are found to be illegal it will not affect or impact the validity of the other Terms.
